1. Acceptance of the Terms
By accessing and using the website tourgal.pt, owned by Tourgal, you agree to comply with these Terms of Use and applicable law. If you do not agree with any of these terms, you must not use the site.
The continued use of the platform after the publication of changes constitutes acceptance of them.
2. About Tourgal
Tourgal is a tourist discovery platform in Portugal. We provide information on tours, activities, restaurants, places of interest, regions and related content to help travelers and partners explore the country.
Unless otherwise stated, Tourgal acts as an intermediary of information and discovery, not as an organizer or operator of all the experiences listed.
3. User accounts
Some features may require the registration of an account. When creating an account, you undertake to provide true, complete and up-to-date information and to maintain the confidentiality of your access credentials.
You are responsible for all the activity performed through your account. Notify us immediately if you suspect unauthorized use. Tourgal may suspend or terminate accounts that violate these Terms or represent a risk to the platform or other users.
4. Acceptable use
The user undertakes to use the site legally, responsibly and respecting the rights of third parties, only for purposes related to the discovery and management of tourist information provided by Tourgal.
In particular:
- Try to access restricted areas or Tourgal systems without permission;
- Publish or distribute illegal, offensive, misleading or intellectual property rights content;
- Use automated tools (bots, scrapers or similar) to extract mass data or overload the site, except with written permission;
- Introduce malware, attack or any activity that impairs the safety, availability or performance of the platform;
- Use Tourgal fraudulently or for unauthorized commercial purposes.
5. Content and intellectual property
Texts, images, logos, videos, databases and other materials presented on the site are the property of Tourgal or third parties who have authorized us to use them. All rights are reserved unless otherwise specified.
It is not permitted to copy, reproduce, modify, distribute or commercially exploit this content without prior written consent from Tourgal or its holder, except within the limits permitted by law (e.g. personal and private use).
If you submit content to the platform (e.g. comments, reviews or site suggestions), you grant Tourgal a non-exclusive license to use, reproduce and present it within the scope of the services, without prejudice to your moral rights and applicable legislation.
6. Reservations and relations with providers
Tourgal adds information about business, tours and experiences. In many cases, the reservation, payment and provision of the service are the responsibility of the provider (tourist operator, restaurant or other partner), rather than Tourgal.
When redirected to a third party website or system, the terms and privacy policy of that provider shall apply. We recommend you read them before completing any booking or purchase.
Tourgal strives to keep the information up to date, but does not guarantee that prices, times, availability or descriptions are always correct or complete. Always confirm the details directly with the provider.
7. Limitation of liability
To the extent permitted by Portuguese law, Tourgal is not liable for indirect damage, outgoing profits or losses arising from the use or impossibility of using the website, nor for acts or omissions of third party providers whose services are presented on the platform.
The website is available ‘as it is’. We do not guarantee uninterrupted availability, absence of errors or that the transmission of data over the internet is completely safe. Nothing in these Terms excludes or limits liability that the law does not allow to exclude.
8. Links to third parties
The website may contain links to third-party websites, applications or services. These calls are provided for convenience only. Tourgal does not control or endorse the content or practices of these sites and does not take responsibility for them.
9. Changes to Terms
We may update these Terms of Use periodically. The date of the last update will be indicated on this page. In the event of substantial changes, we may inform users via the website or by other appropriate means. Continuing to use the platform after the changes have entered into force, accepts the updated version.
10. Applicable law
These Terms are governed by Portuguese law. Without prejudice to mandatory consumer rights, the Portuguese courts are competent to resolve disputes arising from the interpretation or enforcement of these Terms.
